Yes, an agreed reference is usually part of the transaction agreement, but this is one of the things that is often forgotten. An agreed reference entitled “Appendix A” is then affixed to the back of the settlement agreement itself. There is no obligation for an employer to provide a reference and one of the advantages of settling a case is that a reference contract can be concluded as part of the agreement.
